“Canon Education Store Member Referral Program” Terms and Conditions

Canon Hongkong Company Limited (“Canon”) is the organizer of Canon Education Store Member Referral Program (“Activity”).
If you are a Club Canon member (“Referrer”), upon forwarding the Referrer’s invite code issued by Canon (“Invite Code”) to a third party, you are deemed to have read, understood and agreed to be bound by the terms and conditions set out below (these “Terms and Conditions”).
If you are not a Club Canon member (“New Member”), upon registering as a Club Canon member using any Invite Code during the Promotion Period, you are deemed to have read, understood and agreed to be bound by these Terms and Conditions.
The Activity is valid from 13 September, 2017 to 30 September, 2017 (“Promotion Period”).

Eligibility

Referrer must register as a Club Canon member and provide your Hong Kong tertiary institution email address under your Club Canon member account and complete the verification procedures prescribed by Canon on or before 28 September, 2017. Referrer will receive your Invite Code within 3 working days (on or before 29 September, 2017 by 12pm) after successful registration.
To be eligible in the Activity, New Member must complete the following steps during Promotion Period:
- register as a Club Canon member;
- provide your Hong Kong tertiary institution email address and complete the verification procedures prescribed by Canon; and
- provide Referrer’s Invite Code to Canon when registering as a Club Canon member.
Both Referrer and New Member must choose “Yes” under the “Accept direct marketing” option under your Club Canon member account in the Promotion Period.

Disqualification

Canon reserves the sole and absolute right to disqualify or exclude you from this Activity and/or Prize without prior notice if you:
- commit a breach of these Terms and Conditions;
- provide untrue or incomplete personal information;
- provide inconsistent personal information at the time of enrollment and claiming Prize;
- are found to be participating in this Activity in any illegal or dishonest manner; or
- are considered by Canon to be suitable to be disqualified or excluded under reasonable circumstances.

Prize Redemption Arrangement

The first 200 Referrers whose Invite Codes have been used by 2 or more New Members to successfully register as a Club Canon member in this Activity within the Promotion Period shall be eligible to one of following prizes (“Prize 1”):

All Prizes are available on a first-come-first-served basis and while stocks last.
The first 1,000 New Members who successfully register as a Club Canon member within the Promotion Period shall each receive a EOS Tote Bag (“Prize 2”, collectively “Prize” with Prize 1).
The top Referrer whose Invite Code has been used by the highest number of New Members to successfully register as a Club Canon member in this Activity within the Promotion Period shall receive a SEPLHY CP1200 Compact Photo Printer (“Prize 3”, collectively “Prize” with Prize 1 and Prize 2). In case more than one Referrer successfully referred the same number of New Members, Prize 3 will be awarded to the Referrer who first accumulated the said number of New Members.
Multiple uses of each Invite Code by different New Member are permitted.
You are only eligible for a maximum of one Prize 1, one Prize 2 and one Prize 3 in this Activity.
Canon will notify the winner of details of the prizes redemption arrangement by email according to email address provided under your Club Canon member account within 4 weeks after the end of the Promotion Period. If, due to incomplete or incorrect information provided by you, Canon is unable to notify you within 4 weeks after the end of the Promotion Period or you have not claimed the prize within 30 days after the notification email has been sent out, you shall be deemed to have waived your rights to receive the prizes and Canon shall be entitled to exercise its sole and absolute discretion to disqualify you, and to use such prizes for any purposes as Canon deems fit.
The Prizes are not transferable or exchangeable for cash and/or any other goods.

The use of the Prizes is subject to its terms and conditions or the terms and conditions of the relevant merchant.
Canon shall not bear any responsibility for replacing any damaged, lost or stolen Prizes.
All Prizes and its related products and services shall be provided or sold by the relevant merchant to you directly. All legal responsibilities shall be borne by the relevant merchant. Canon is not liable nor does it provide any guarantee regarding the quality of any products or services.
If, due to any reason caused by the relevant merchants, including but not limited to the relevant merchants have a shortage of Prizes, discontinue the production of Prizes or delay the delivery of the Prizes to Canon, Canon is unable to distribute the Prizes in accordance with these Terms and Conditions, Canon reserves the right to, at its sole and absolute discretion, postpone the distribution of the Prizes or substitute any Prize with any other item of similar value. You are not entitled to select the style or color of the Prizes.

Personal Data

The personal data provided and collected will be used by Canon for one or more of the following purposes:
- For creation, processing and maintenance of your enrollment record, the administration and monitoring of this Activity;
- For statistical and analytical purposes; and
- Any other legitimate purposes as may be required, authorized by law.
The provision of personal data is voluntary. If you do not provide sufficient information, you may not be able to enroll this Activity. Canon will treat the personal data provided by you in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and with our privacy policy (http://www.canon.com.hk/en/corporate/main/privacy_policy.jspx) amended from time to time.
The personal data you provided are mainly for use within Canon but the information may also be disclosed by Canon to other third parties for the purposes stated above, if required.
You have the right to request access to and correction of your personal data under sections 18 and 22 and principle 6, schedule 1 of the Personal Data (Privacy) Ordinance (Cap.486). Canon may impose a fee for complying with a data access request.

Other Terms

Canon shall not be liable to you for any loss, damage, cost and expense directly or indirectly suffered by you (including but not limited to, loss of profit, loss of saving, loss of goodwill, loss of revenue or loss of contract incurred by you, whether anticipated or actual, or any special indirect or consequential damages of any nature whatsoever) or any action, claim and proceeding taken against you by any third party or parties in connection with, incidental to and consequential upon the performance of Canon or its employees or independent contractors in relation to this Activity. Notwithstanding anything to the contrary, to the extent permitted by law, Canon’s total aggregate liability in contract, tort, equity or otherwise for any direct loss or damage arising out of or in connection with this Activity shall be limited to HK$100.
Canon will under no circumstance be liable for any loss or damage caused by any problem or technical malfunction of any communication network, online system or computer hardware or software failure; or any incorrect data input during the online submission.
All time is based on the time of receipt at the server. Late registration will not be entertained.
Any failure or delay by Canon to exercise or enforce any right under these Terms and Conditions shall not be deemed to be a waiver of that right nor operate to bar the exercise or enforcement of it at any time or times thereafter.
The provisions contained in each clause of these Terms and Conditions shall be enforceable independently of each of the others and its validity shall not be affected if any of the others is invalid. In the event any provision of these Terms and Conditions is determined to be illegal, invalid, or unenforceable, the validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.
Canon reserves the right to interpret these Terms and Conditions. In case of any dispute, Canon reserves the right of final decision.
These Terms and Conditions shall be governed and interpreted by the laws of the Hong Kong Special Administrative Region. You hereby irrevocably submit to the exclusive jurisdiction of the Hong Kong Courts in connection with any disputes arising from or in connection with these Terms and Conditions.
These Terms and Conditions are prepared in English and the Chinese translation is provided for reference only. In case of any inconsistency or ambiguity, the English version shall prevail.
